Directed by the provisions of the Pre-Action Protocol for Claims for Damages in Relation to the Physical State of Commercial Property at the Termination of a Tenancy, more favourably referred to as the 'Dilapidations Protocol' and encompassed by the pre litigation protocol Civil Procedure Rules, our aligned approach to dilapidations claim schedule preparation acts to put our clients on the front foot.
Whether acting in anticipation of the determination of a leasehold interest contractual term, post term or during the term to prepare terminal schedules of dilapidations or interim schedules of dilapidations, careful consideration of the repairing covenants contained in the lease documents, relative to the condition, configuration and closer particulars of the subject property, enables detailed and accurate schedule preparation.
Terminal schedules of dilapidations readily carry through to pre or immediately post term claim negotiation. Interim schedules of dilapidations may enable dialogue to be established between the parties or require transposition to schedules of works pursuant to notices to repair, should matters escalate.
